These terms govern access to and use of FoodSpotter, whether through the website or the mobile app. Using the service constitutes acceptance.
FoodSpotter is free to access. Browsing the map, searching and suggesting spots do not require an account. Some features — favourites, reviews, tracking your contributions — require registration. The publisher may suspend access for maintenance or technical reasons, without this giving rise to any compensation.
Registration requires a valid email address and a password. You are responsible for keeping your credentials confidential and for actions taken from your account. An account may be suspended or deleted for breach of these terms, after informing its holder except in an emergency or where required by law. You may delete your account at any time from your profile; deletion is permanent.
By posting content — a spot, review, photo or report — you declare that you hold the rights to it and grant the publisher a free, non-exclusive licence to reproduce and display it, solely to operate the service, for as long as it remains published. The following are prohibited: false or misleading, insulting, defamatory or hateful content, content infringing privacy or third-party rights, and any posting for advertising purposes unrelated to the service. Contributions are moderated, either upfront or following a report. The publisher may remove any content that breaches these terms or the law. A removal decision may be challenged at contact@foodspotter.app.
FoodSpotter offers optional paid plans giving access to additional features and removing advertising. The purchase channel depends on your status.
Plans intended for consumers are purchased exclusively from the mobile app, through the App Store or Google Play. No consumer purchase is possible on the website. The store concerned is then your seller: it takes the payment, issues the receipt and handles refund requests. Its terms and refund policy apply, including as regards withdrawal and dispute mediation. The price is displayed by the store before any confirmation, inclusive of all taxes. Subscriptions renew automatically; cancellation is made in your App Store or Google Play account settings, at least twenty-four hours before renewal. One-off purchases are paid once and do not renew.
Business plans are purchased on the website, from your account area, by card through our payment provider Stripe. We store no card details. These plans are intended for professionals acting in the course of their business; the contract is concluded directly between your company and the publisher. The price is displayed before any payment confirmation, in euros. The applicable VAT statement appears on the invoice, issued at each renewal and available in your account area. Subscriptions renew automatically; cancellation is available at any time from your business account area. Access continues until the end of the period already paid for, with no pro-rata refund. The fourteen-day right of withdrawal provided by French consumer law applies to consumers. It does not apply to a business subscription.
Published information comes largely from the community. The publisher guarantees neither its accuracy nor its currency, and cannot be held liable for a wasted journey or any damage resulting from its use. The service is provided as is, without any guarantee of continuous availability.
These terms may be amended. Any substantial change is brought to your attention within the service and takes effect fifteen days after that notice. Continuing to use the service constitutes acceptance.
These terms are governed by French law. As consumer plans are purchased from the App Store or Google Play, the store concerned is your seller: the remedies and mediation channels it offers apply. For any question about the service itself, write to us at contact@foodspotter.app. Disputes arising from a contract between businesses do not fall within consumer mediation. We favour amicable settlement; failing that, the French courts have jurisdiction. You may also use the European online dispute resolution platform: ec.europa.eu/consumers/odr.
